At this time, 7 Days In May is accepting registration for the single day and 2 (or 3) day ride options. However, we will not be collecting registration fees at this time until we are certain that Provincial COVID Guidelines will allow us to safely conduct an in person event for 2022 for crowds greater than 50 people. We expect to be able to confirm an in person event early in the new year and will commence invoicing and collecting of payments at that time.

    I agree to obey all Ontario Highway Traffic Act laws and, as appropriate, the New York State Vehicle and Traffic Act Laws.

    I grant my permission to use photographs or recordings of my participation in this event.

    No fixed gear, motorized, or powered bicycles permitted.

    No baseball caps, headphones or ear buds permitted while riding. All riders agree to wear a certified and approved cycling helmet at all times while riding.

    Personal information contained on this form is collected pursuant to the Municipal Freedom of Information and Protection of Privacy Act and will be used solely for the administration of this event.

    I ATTEST AND VERIFY THAT I AM 18 YEARS OF AGE OR THAT I AM SIGNING AS THE LEGAL GUARDIAN ON BEHALF OF AN EVENT PARTICIPANT UNDER THE AGE OF 18 YEARS.

    Waiver of Liability, Assumption of Risk and Indemnity Agreement (“WAIVER”)

    I, for myself, my heirs, personal representatives or assigns, covenant not to commence a civil claim, action, or suit and do hereby forever release, waive, and discharge from liability, PEOPLE ON BIKES INC. (hereinafter referred to as “PEOPLE ON BIKES”) their owners, officers, directors, employees, volunteers, or agents, from liability for any and all claims, costs, expenses and settlements, including the negligence of PEOPLE ON BIKES, their owners, officers, directors, employees, volunteers or agents, resulting in personal injury, accidents or illnesses including death, and property loss arising from, but not limited to the ‘7 Days in May’ recreational bicycle ride event hosted by PEOPLE ON BIKES, held between May 23rd, 2020 to May 29th , 2020 (the “Activity”).

    Acknowledgement: I am at least EIGHTEEN (18) YEARS of age and have been sufficiently informed of the foreseeable risks to my personal safety and any minor child in respect of whom I sign this Agreement on behalf of, arising from, and associated with my/our participation in the Activity. I declare that in participating, or in permitting the participation of any minor child in respect of whom I sign this Agreement (the “Child”), in the Activity, I/we waive any claims that I/we may have PEOPLE ON BIKES, from all liability for injury, death, damage or loss (financial, economic, to property or otherwise) sustained as a result of my/our participation, or the participation of any Child, in the Activity. I/we agree that there is a risk factor in the Activity which cannot be lessened by PEOPLE ON BIKES, and I further agree to closely supervise my Child during my/our participation in the Activity.

    Assumption of Risk: Participation in the Activity, and recreational bicycling on paths, roadways and highways, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid such personal injury, accidents or illnesses including death, and property loss. These inherent risks include, but are not limited to, risk of falling, risk of collision with other bicycles, risk of collision with pedestrians, risk of collision with motor vehicles, risk of collision with stationary objects, risks associated with weather conditions (adverse or otherwise), risks associated with path, roadway or highway conditions (adverse or otherwise), etc. I/we have been sufficiently advised by PEOPLE ON BIKES, their owners, officers, directors, employees, volunteers or agents, to obtain and utilize the proper safety precautions necessary to mitigate the inherent risks of the Activity, including but not limited to proper supervision, personal protective equipment, life insurance, health insurance and disability insurance. I acknowledge and confirm on my own behalf and on behalf of any Child in respect of whom I sign this Agreement on behalf of, that: (i) I/we are physically capable and sufficiently trained to participate in the Activity, (ii) I will ensure that I/we are equipped with proper personal protective equipment during my/our participation in the Activity (including, but not limited to: correctly wearing a bicycle helmet and ensuring that my/our bicycle and ancillary equipment are in good mechanical condition and working order), and (iii) I/we shall not at any time wear any items (i.e. hats, earphones, headphones, etc.) that may impair or otherwise inhibit me/we from the correct use of proper personal protective equipment during my/our participation in the Activity.

    Consent: I hereby consent to and permit emergency medical treatment to be performed on me and on behalf of any Child in respect of whom I sign this Agreement on behalf of, in the event of personal injury or illness.

    Acknowledgement: I hereby acknowledge and agree that I, and any Child in respect of whom I sign this Agreement on behalf of, shall at all times obey or otherwise comply with all applicable laws relating to the Activity, including, but not limited to the Highway Traffic Act (Ontario) and any vehicle and traffic laws applicable in the State of New York, United State of America.

    I have read the previous paragraphs and I know, understand and acknowledge these and other risks inherent with the Activity. I hereby assert that my participation and the participation of any Child, is voluntary, that I knowingly assume all such risks and I assume full responsibility for any and all risks of property damage, personal injury, or death.

    Indemnification and Hold Harmless: I hereby agree to Indemnify and Hold Harmless PEOPLE ON BIKES, their owners, officers, directors, employees, volunteers or agents, from any and all claims, actions, suits, procedures, costs, expenses damages and liabilities, including attorney’s fees brought as a result of my involvement, or the participation of any Child, in the Activity, to reimburse them for any such expenses incurred and hereby release, waive and forever discharge them, their heirs, administrators, executors and assigns of any and all claims, demands, actions or rights of action of whatever kind or nature, in law or in equity, arising from or by reason of my participation, or the participation of any Child, in the Activity.

    Severability: The undersigned further expressly agrees that the foregoing waiver and assumption of risk agreement is intended to be as broad and inclusive as is permitted by law in the Province of Ontario and that if any portion of this Waiver is held invalid, the balance of the Waiver shall continue in its full legal force and effect.

    Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

    Electronic Delivery: This Waiver may be executed and delivered by electronic means under the Electronic Commerce Act, 2000 of Ontario.
    Agreement of Understanding: I have CAREFULLY read this Waiver, fully understand its terms and understand that I am giving up substantial rights including my right to sue. I acknowledge that I am signing this Waiver freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
